AUGUSTA – Attorneys met with a judge today trying to determine whether prosecutors will be allowed to forcibly medicate a Gardiner man accused of killing his father.
Leroy Smith III is charged with May of 2014 murder of 56-year-old Leroy Smith Jr. Police say he dismembered the body and spread body parts around a rural area in Richmond.
At a hearing last January a judge found Smith to be incompetent to stand trial. The state is requesting to have some access to Smith’s treatment records and allow him to be forcibly medicated so that he may be able to go on trial.
Smith’s attorney claims forced medication is a violation of his constitutional rights.
The younger Smith is expected to be in court for a hearing on December first.
He is currently being held at the Riverview Psychiatric Center
