BANGOR – A murder trial scheduled to start Monday at the Penobscot Judicial Center has been delayed by a day.
F Daly, 31, of Bangor is charged in the January 2018 shooting death of Israel “Izzy” Lewis, 51, at his rooming house residence on Second Street.
Daly’s defense attorney said a witness for the prosecution recently went into the hospital because of a medical condition and is expected to be there for weeks.
“So that’s going to prevent his ability to appear in the courtroom so we had to make arraignments regarding a deposition as an alternative measure to present his testimony,” said Jeffrey Silverstein, who, along with Kaylee Folster, is representing Daly.
Justice Ann Murray decided to delay the start of the trial until his deposition is collected, Silverstein said.
The deposition is scheduled for Monday afternoon.
Silverstein said the time would be used to finalize the jury for the trial, which now is scheduled to begin Tuesday morning.
